SPECIFIC TERMS AND CONDITIONS OF THE ECOALF COMMUNITY

WE RECOMMEND THAT YOU READ AND UNDERSTAND THE TERMS AND CONDITIONS IN ORDER TO BECOME A MEMBER OF THE ECOALF COMMUNITY. ACCEPTANCE OF THESE TERMS IS REQUIRED TO FORMALIZE YOUR REGISTRATION AS A MEMBER OF THE ECOALF COMMUNITY.

1. ECOALF COMMUNITY

The Ecoalf Community is promoted by the company ECOALF RECYCLED FABRICS, S.L. (hereinafter, “ECOALF”), a commercial company registered under tax identification number B-85910610 and having its registered office at C/ Gran Vía 1, 2º izq, 28013 Madrid.

ECOALF offers members of the Ecoalf Community a series of advantages and privileges.

In order to become a member of the Ecoalf Community, it is necessary to create a Community member account through the ECOALF website or by requesting the registration form in any of our physical stores. ECOALF reserves the right to reject membership for any user who does not follow the registration procedures.

2. CONDITIONS

Membership in the Ecoalf Community, and therefore the enjoyment of its benefits, implies acceptance of the sending of our Newsletter. However, members of the Community may unsubscribe from these communications, which implies the loss of their status as Community member and, therefore, of the benefits offered. Nevertheless, the member who decides not to receive our Newsletter shall retain their profile as a registered user and may access their purchase history, returns, and any other information contained in their account, provided that it is not cancelled.

Being a member of the Ecoalf Community is a personal and non-transferable condition, and its assignment, loan, or sale is not permitted. Its use for purposes other than those defined in these Particular Terms and Conditions is also not allowed.

3. OBTAINING BENEFITS

By registering as a member of the Ecoalf Community, you will be able to enjoy the following benefits:

Access to exclusive collections: members of the Ecoalf Community may exclusively access private sales.
10% birthday discount: members of the Ecoalf Community will receive a 10% discount on their birthday to spend on their next purchase. The 10% birthday discount will be generated on the day indicated by the user as their date of birth, and only once per year. The discount will be redeemable for 12 months, after which, if unused, it will expire and shall not be cumulative with the following year.
Early access to sales: members of the Ecoalf Community will be able to access our sales before other customers.

4. DATA UPDATE

In order to formalize registration as a member of the Ecoalf Community, the user must provide the requested data either through the form available in stores or through the website.

The member of the Ecoalf Community guarantees the accuracy of all information provided and shall be solely responsible for any incorrect, incomplete or outdated information.

The member of the Ecoalf Community may modify or update their data by sending an email to: gdpr@ecoalf.com

5. DURATION AND MODIFICATION OF THE ECOALF COMMUNITY CONDITIONS

ECOALF reserves the right to modify or suspend the Ecoalf Community at any time. In the event of suspension, ECOALF undertakes to inform Community members by email sent to the addresses provided, without having to justify its decision and without any compensation in favor of the Community member.

Likewise, the Terms and Conditions of the Ecoalf Community may be modified at any time and without prior notice by ECOALF. The most updated version of the Terms and Conditions will always be available on the website www.ecoalf.com, which users may consult at any time. However, in the event that the changes to said Conditions are substantial, users will be duly informed so that they may decide whether they wish to continue being part of our Community.

6. CANCELLATION

Members of the Ecoalf Community may cancel their membership at any time by notifying ECOALF in writing via the address gdpr@ecoalf.com

In the event of cancellation of membership, the user registered as a member of the Ecoalf Community shall lose the right to use all benefits and advantages granted by the Ecoalf Community.

In the event of cancellation of the account as a member of the Ecoalf Community, all data will be deleted, except those relating to purchases, which must be kept for a maximum period of 5 years in order to respond to any incidents that may arise in this regard.

7. LIABILITY

The member of the Ecoalf Community is solely responsible for the use of the associated benefits, and ECOALF shall therefore be exempt from any liability in this regard. In this sense, ECOALF shall not be liable for:

a) The use or purpose that the user may give to their status as a member of the Ecoalf Community;
b) Any breach of the obligations stipulated in these Particular Terms and Conditions;
c) Any deficiency, failure in data processing, etc. not directly attributable to ECOALF or beyond ECOALF’s reasonable control;
d) Any indirect damage caused to the user that may derive from their status as a member of the Ecoalf Community or from the advantages or services provided in accordance with these Particular Terms and Conditions;
e) Damages arising from the misuse of their status as a member of the Ecoalf Community in accordance with these Particular Terms and Conditions;
f) Damages and/or losses of any nature that may be due to the lack of availability, reliability or continuity of its website or its services.

8. DATA PROTECTION

The personal data of members of the Ecoalf Community shall be processed in accordance with these Terms and Conditions and ECOALF’s Privacy Policy.

10. SEVERABILITY

If one or more provisions of these Particular Terms and Conditions are declared null or unenforceable by applicable law or by a final judicial decision, the remaining provisions shall remain valid and in force.

11. APPLICABLE LAW

These Particular Terms and Conditions shall be governed and interpreted in accordance with current Spanish legislation. Any discrepancy between the member and ECOALF regarding the validity or enforceability of any provision contained herein shall be resolved before the Courts and Tribunals of Madrid.
